Justice Kennedy, who turns 74 this month, has told relatives and friends he plans to stay on the high court for at least three more years – through the end of Obama’s first term, sources said.
That means Kennedy will be around to provide a fifth vote for the court’s conservative bloc through the 2012 presidential election. If Obama loses, Kennedy could retire and expect a Republican President to choose a conservative justice.I may not agree with every Supreme Court decision that Kennedy's been a part of the majority on, but you know this is just one of those definite, "You're challenging the job I'm doing" response (in particular to the accusations during the SOTU address).
There are people who are claiming this is just Kennedy being "noisy" to be "noisy"... but if he weren't going to retire anyway, why put it out where it can be picked up on the airwaves. Nope, this was a retaliation shot from a Supreme Court Justice, informing our President that if you want to pick a fight with the old man, you better fight smarter or dirtier than he does... and Kennedy is one of the best at doing both.
